These Terms of Service ("Terms") govern your access to and use of the CallMyKin mobile application ("App") and website ("Website"), collectively referred to as the "Services", provided by Zetara Pty Ltd ("Company", "we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Use of Services

1.1 Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have your parent or guardian's permission to use our Services.

1.2 Account Registration

To access certain features of the Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

1.3 Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services
• Use any robot, spider, scraper, or other automated means to access the Services
• Transmit spam, chain letters, or other unsolicited communications
• Impersonate another person or entity
• Collect or harvest any personally identifiable information from the Services
• Engage in any activity that could disable, overburden, or impair the proper working of the Services

You retain ownership of any content you submit, post, or display on or through the Services ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, copy, modify, and display your User Content in connection with operating and providing the Services.

If you provide any feedback or suggestions regarding the Services, we may use such feedback without any obligation to compensate you or credit you for such feedback.

3. Subscriptions and Payments

3.1 Subscription Plans

Some features of the Services may be available through subscription plans. Subscription fees are billed in advance on a recurring basis according to the plan you select.

3.2 Payment Processing

All payments are processed through Apple Pay or Google Pay. By subscribing, you agree to their respective terms and conditions. We do not store your payment card information.

3.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period.

3.4 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. Please contact the app store through which you made your purchase for refund inquiries.

4. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. By using the Services, you consent to our collection and use of personal data as outlined in the Privacy Policy.

5. Third-Party Services

The Services may contain links to or integrate with third-party websites, services, or resources that are not owned or controlled by us. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 No Guarantee

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

6.3 Accuracy

While we strive to provide accurate Chinese kinship terminology across Cantonese, Mandarin, Hakka, and Hokkien dialects, we make no guarantees regarding the accuracy or completeness of the content. The terminology may vary by region and family traditions.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorised access, use, or alteration of your transmissions or content

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Services.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
